Mediation

A form of alternative dispute resolution (ADR), mediation is an avenue through which a resolution is reached outside of court with the help of a neutral third-party, the mediator, who works to find points of agreement and helps the disputing parties reach a fair and reasonable agreement. This is a process that requires honest negotiation in order to reach the best possible result for all involved parties. If the parties can work collaboratively to reach a fair resolution, mediation can be less contentious and often more cost-effective than traditional litigation.

Arbitration

Arbitration is another form of ADR, slightly different from mediation. Through this process, both parties present their cases to a neutral arbitrator (or panel of arbitrators) that then render a decision in the case. Arbitration is essentially a mini-trial with less formalities than your typical courtroom hearing. The decision of the arbitrator or panel is legally binding, and the parties waive their right to a formal trial by submitting to this form of ADR.
